Fate of 3 Punjab Info Selectees Hangs in Balance -- Case Adjourned To 07 Jan 2012

CHANDIGARH: 01 DECEMBER 2011: During resumed hearing of the PIL filed by RTI Activist-cum-Advocate H.C. Arora, inter-alia, challenging the appointments of 2 Information Commissioners, namely Bidhi Chand and Chander Parkash, today the State of Punjab's application for seeking modification of interim order of 17 November did not come up for hearing, as it was not listed in the Cause List, and with the Additional Advocate General for State of Haryana seeking more time for filing reply, the Bench comprising Justice M.M. Kumar and Justice R.N. Raina adjourned the further hearing to 07 January next.

 

Vide its interim order dated 17 November Passed by the HC Bench had restrained the Governments of Punjab and Haryana from making any appointment of any person as State Information Commissioner "without following transparency and equitable procedure consistent with Article 14 of the Constitution as enumerated in para no. 72 of the Full Bench judgment" in CWP No. 11846 of 2011 (Salil Sabhlok v. Union of India) decided on 17 August last.  The said interim order had come on an application filed by Petitioner in view of reports in press that the name of Alit Singh Chanduraian was recommended by the Selection Committee comprising CM, Punjab, Cabinet Minister and Leader of Opposition.

 

With the PIL being adjourned to 07 January next, the fate of  Surinder Awasthy, Inderjit Singh Chanduraian and  Narinderjit Singh, IAS (Retd.), whose names were cleared by the Selection Committee recently hangs in the balance for the time being.
